Fingal County Council has won a High Court case which was aimed at blocking the public realm project in New Street in Malahide, Co Dublin.
Cllr Eoghan O’Brien (FF) said: “Delighted that Fingal County Council has won the case taken by Nicola Byrne against the Part 8 New Street public realm enhancement scheme that was approved by an overwhelming majority of elected members of FCC. I look forward to this multi-million euro scheme going ahead.”
Cllr David Healy (Greens) said: “The High Court has ruled Fingal’s redevelopment of the pedestrianised New Street in Malahide can go ahead, but we need to do a local area plan for Malahide.”
A note to councillors from Fingal County Council officials said: “Please see attached details of the High Court judgement on New Street. Judge Humphreys has delivered his judgment in Nicola Byrne’s Judicial Review proceedings, which is attached.”
“Judge Humphreys has granted a declaration only on the LAP issue and has awarded Ms Byrne the costs of just that aspect of her case only; and, Fingal has been successful on all of the other grounds, which have been dismissed and so the Part 8 has not been quashed,” the note from an official said.
It added: “Thank you all for your support and I look forward to working with you all on the delivery of the scheme.”
